Fizzywhiz Terms & Conditions
Last updated: 12 October 2026
These Terms govern sales through fizzywhiz.com, portal.fizzywhiz.com and other authorised Fizzywhiz channels. Fizzywhiz
sells physical goods to consumers and businesses; cosmetic assessment and related compliance services are offered for
business use. A customer is a consumer where they act wholly or mainly outside their trade, business, craft or profession.
Mandatory consumer rights always prevail over conflicting wording. Contact: info@fizzywhiz.com; 0151 922 0041. Returns:
Unit 23, Maritime Enterprise Park, Atlas Road, Bootle, Liverpool, L20 4DY.
1. General sale of goods
1.1 Orders
An order is an offer to purchase. Automated acknowledgement confirms receipt, not acceptance. We accept when we
expressly confirm or dispatch. We may decline an unaccepted order for reasonable grounds including unavailable stock,
obvious price errors, failed payment or suspected fraud; any payment taken will be refunded.
1.2 Prices and payment
Prices are in GBP and include VAT where applicable. Delivery charges are shown before checkout. We may correct an
obvious price error before acceptance and offer cancellation or purchase at the correct price. Customers must be authorised
to use the selected payment method.
1.3 Descriptions, images and fragrances
We take reasonable care over descriptions. Minor photographic, screen, batch and packaging differences may occur, without
affecting rights where goods do not conform to contract. Scent perception is subjective. Descriptions and comparisons to
third-party fragrances are illustrative, not a promise of identical scent or brand affiliation. Personal dislike alone is not proof of
defect; consumer cancellation rights remain unaffected.
1.4 Reformulations and documentation
Suppliers may reformulate fragrances or ingredients because of availability, IFRA standards or regulatory developments.
Customers making finished goods must check the supplied version and current SDS, IFRA, allergen and other relevant
information for their intended use. We will not knowingly misdescribe supplied goods.
1.5 Testing, use and storage
Customers must follow safety instructions, storage requirements and relevant maximum use limits. Commercial makers must
carry out suitable formulation, compatibility, stability and finished-product testing and meet applicable legal requirements.
This does not excuse Fizzywhiz from liability for defective goods.
1.6 Delivery
Delivery services and charges are specified at checkout. Typical standard delivery is 3–5 working days; express is 1–2
working days, with a usual weekday 10:30 am cut-off, subject to availability and exclusions. Estimates are not guarantees
unless expressly agreed. We comply with statutory consumer delivery obligations. Overseas import taxes and duties may
apply.
1.7 Risk and delivery investigations
For consumers, risk generally passes on physical receipt by the customer or nominated recipient, subject to legal exceptions.
For business orders, risk passes on agreed delivery unless otherwise specified. Tracking and delivery photos are evidence,
not automatically conclusive proof. Notify us promptly of missing, damaged or incorrect deliveries so we can investigate.
1.8 Consumer cancellation
Eligible consumers buying online generally have 14 days after delivery to cancel, subject to statutory exceptions. Notice must
be given within the cancellation period and goods returned within 14 days of notice. Refunds, standard outbound shipping
and return-cost allocation follow applicable law and pre-contract disclosures. Handling beyond what is needed to inspect
goods may justify a lawful deduction. Opening a fragrance bottle does not automatically extinguish statutory cancellation
rights.
1.9 Voluntary 30-day returns
In addition to legal rights, Fizzywhiz offers a voluntary return route for eligible unopened, unused, resaleable goods within 30
days of receipt. Opened fragrance oils, used items and bespoke goods may be excluded from this voluntary policy. Business
change-of-mind returns are discretionary unless agreed. Customers should contact us first and package returns securely.
This does not restrict faulty-goods rights.
1.10 Faulty or incorrect goods
Where goods are faulty or not as described, we provide remedies required by applicable law. We may request photos, batch
details or a return for reasonable investigation. Where we are responsible for an error or fault, legally required reasonable
return costs will be met.
1.11 Offers and promotions
Promotions are governed by clearly disclosed dates, eligibility, exclusions and stock limits. Unless stated otherwise, codes
cannot be combined and have no cash alternative. Fairly disclosed conditions may require return of free gifts when the
qualifying order is cancelled. Earned statutory rights remain unaffected.
1.12 Resale and finished products
Customers may lawfully sell finished goods manufactured using suitable raw materials, subject to compliance. They must not
suggest Fizzywhiz is the Responsible Person, manufacturer or endorser of those finished goods without authorisation. No
licence to copy our branding, imagery or documentation is granted.
2. Cosmetic assessments and compliance
2.1 Business services
Assessments, compliance templates and assessment subscriptions are offered for business use. Customers must provide
accurate business and Responsible Person information. Consumer status is determined by law, not solely by a checkout
declaration.
2.2 Assessment scope
Each assessment covers only the expressly stated formula, ingredients, variants, versions, usage conditions and product
category. It does not automatically approve altered recipes or new fragrance versions. Independent qualified assessors may
prepare or review documents; their professional conclusions are not replaced by general customer support.
2.3 Responsible Person
Unless separately agreed in writing, Fizzywhiz is not the Responsible Person for customer-manufactured cosmetics. The
Responsible Person must ensure a compliant PIF, required notifications, labelling, GMP, claims, traceability, ongoing safety
and retention of legally required records.
2.4 Changes and reissues
Customers must notify us of material changes in ingredients, formulas, usage, business or Responsible Person details.
Reassessment or a new issue may be needed and may incur a fee quoted in advance. Documents must not be transferred
or presented as issued to another business without appropriate authorisation. Genuine administrative errors and legal
remedies will be addressed reasonably.
2.5 Regulatory updates
An assessment represents its stated scope at issue. Future reviews, new formulations, reissues and regulatory updates are
included only where expressly promised in the product listing or written agreement. We may withdraw or revise affected
materials where law, supplier data or safety information changes. Customers must decide whether to suspend manufacture
or sale pending verification. Nothing excludes remedies for a failure to supply the service as contracted.
2.6 Recordkeeping and commercial outcomes
Customers should download and securely retain versions of assessments, recipes and supporting technical documents.
Purchase is not a guarantee of sales, profitability or regulatory approval beyond the issued scope.
3. Assessment portal, recipes and intellectual property
3.1 Access and security
The portal delivers assessments and related resources. Customers must protect login credentials and must not share
accounts. Reasonable maintenance, security work and migrations may interrupt access. We may change or retire services
with reasonable notice where practicable, while honouring applicable paid-service and statutory obligations. Download and
retain your own copies.
3.2 Digital cancellation rights
Where consumer digital-content cancellation law applies, immediate access removes the 14-day cancellation right only if all
required consent, acknowledgement and confirmation steps are completed. Digital content must still meet applicable legal
standards. Business purchases follow disclosed contract terms subject to law.
3.3 Ownership and permitted use
Fizzywhiz retains rights it owns in branding, images, recipes, methods, guides, templates and training. Independent
assessors and other third parties retain their own rights. Purchase grants a limited, non-exclusive, non-transferable licence
for the documented permitted business purpose; it does not transfer copyright or authorise distribution.
3.4 Prohibited sharing
Without written permission, customers must not sell, publish, distribute, teach from, upload for public access, include in
courses or kits, or materially reproduce protected Fizzywhiz recipes, instructions, templates or training materials. This
includes substantial screenshots and disguised rewrites. Customers may use licensed methods to make their own finished
products within scope. Lawful exceptions and independently developed information are not restricted.
3.5 AI and automated copying
Customers must not scrape or use AI/automation to reproduce or redistribute protected portal material without authorisation.
This does not prohibit legally permitted analysis, accessibility tools or ordinary private compliance work that does not infringe
protected rights.
3.6 Misuse and enforcement
We may investigate credible infringement, account sharing, fraud or security risks and proportionately suspend access
where necessary. We may seek lawful takedowns, injunctions and damages. Any costs are recoverable only where legally
permitted. Suspension does not automatically invalidate properly issued assessments or remove statutory remedies.
4. Cosmetic assessment subscriptions and tokens
4.1 Membership terms
The price, included assessments/addendums, minimum commitment, renewal interval and benefits for Bronze, Silver, Gold,
Platinum or any other tier are those prominently displayed and accepted at checkout. Published terms for the chosen plan
prevail over general descriptions here.
4.2 Billing and cancellation
By subscribing, customers authorise the disclosed recurring payment. A 12-month commitment applies only if clearly agreed
for that tier. Cancellation procedures, renewal dates and any minimum-term balance must be shown before purchase and
confirmed. Cancellation stops future renewals as agreed, but does not retrospectively undo an agreed minimum term.
Material changes will be handled according to contract and law.
4.3 Tokens
Tokens are non-cash service credits, not transferable unless expressly allowed. Their earning, usage, expiry, and treatment
on cancellation must be clearly disclosed. A four-week expiry and no-rollover policy applies only if fairly and prominently
agreed. Legal remedies for undelivered services remain available.
4.4 End of membership
When membership ends, new subscriber benefits cease. Previously issued documents remain subject to their proper scope
and licence; cancellation does not automatically make them invalid. Rejoining may be offered on then-current prices and
terms.
5. Discovery Box subscription
5.1 Monthly box
The Discovery Box is a recurring physical fragrance subscription. Contents, quantities, price, delivery and promotional
benefits are described at subscription checkout. Scent selections change monthly; any substitution must be consistent with
the contract and customer rights.
5.2 Renewal and dispatch
The current operating cycle charges on the 1st and targets dispatch from the 7th of each month, subject to stated processing
conditions. Any change to price or core benefits will be notified as required by contract and law.
5.3 Cancellation
The current cancellation policy requires requests by the 15th to stop the following month’s renewal. This deadline and its
consequences must be prominently shown before subscribing and a practical cancellation route provided. Terms cannot
remove mandatory cancellation or refund rights. Pausing is not offered unless expressly advertised.
5.4 Discounts and resources
Monthly fragrance discounts, marketing booklets and private group access are available only on the published conditions.
Resources remain subject to intellectual-property licences. The physical contents retain all applicable consumer rights,
including rights for faulty goods and statutory cancellation where applicable.
6. Customer conduct, disputes and security
6.1 Respectful communications
Threats, harassment, discriminatory abuse, fraud and serious intimidation towards staff or other customers are not tolerated.
We may restrict communications or future service proportionately, and contact authorities where appropriate. Genuine
criticism, truthful reviews, lawful complaints and protected disclosures are not prohibited.
6.2 Complaints
Please contact info@fizzywhiz.com with order details and supporting information so we can investigate. We aim to respond
reasonably and may seek further evidence. Customers are encouraged, but not required, to attempt direct resolution before
legal or regulatory escalation. No term prevents reporting concerns to Trading Standards or other authorities.
6.3 Chargebacks
Please contact us where practical before raising a payment dispute. We may provide relevant transaction, access and
delivery evidence to payment providers. We do not impose an automatic chargeback penalty; only reasonable losses and
costs legally recoverable may be pursued. Suspected fraud may justify proportionate account restrictions.
6.4 Security and acceptable use
Users must not introduce malicious code, bypass security, attempt unauthorised access, scrape restricted data or interfere
with website operation. We may suspend compromised or abusive accounts where proportionate. Third-party payment and
hosting services may have their own applicable terms.
6.5 Records and privacy
We may retain proportionate order, payment, correspondence, compliance and access records for legitimate purposes and
lawful retention periods. Such records may be evidence but are not automatically conclusive. Personal information is
processed in accordance with our Privacy Policy, UK GDPR and Data Protection Act 2018. Data protection rights remain
available.
7. Legal terms and liability
7.1 Consumer liability
Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any
liability that cannot lawfully be excluded. Nothing restricts mandatory consumer remedies. Any liability exclusions below
apply only so far as lawful.
7.2 Business liability
For business contracts only, and so far as reasonable and lawful, Fizzywhiz excludes liability for indirect or consequential
business losses and loss of anticipated profit not arising directly from breach. Subject to non-excludable liability, our
aggregate liability for a claim is limited to the price paid for the affected goods or services, or another cap expressly and fairly
agreed in writing. This clause is subject to applicable reasonableness requirements and does not excuse breach of essential
obligations where unlawful.
7.3 Business indemnity
Business customers are responsible for their own manufacturing, marketing, labels and finished-product compliance. To the
extent lawful, they indemnify Fizzywhiz against third-party losses directly caused by their negligent or unlawful manufacture,
unauthorised use of licensed material or material breach, excluding losses caused by Fizzywhiz’s own breach or negligence.
No automatic recovery of fines or all legal expenses is promised.
7.4 Force majeure
Neither party is liable for delay caused by events genuinely beyond reasonable control, subject to statutory rights and
obligations to mitigate, communicate and provide applicable remedies. Examples include severe supply disruption, courier
interruption, natural disaster and major system outages.
7.5 Title
Ownership of physical goods remains with Fizzywhiz until paid for in full, so far as applicable law permits. Risk transfers
separately under the delivery clause.
7.6 Contract changes
The version of these Terms accepted when an order is placed governs that order. We may update published terms for future
orders. Existing subscriptions may only be varied under a valid agreed variation mechanism and applicable law; continued
use alone does not necessarily establish consent to an unfair material change.
7.7 Entire agreement, severability and waiver
These Terms, relevant product or subscription conditions and confirmed written agreements form the contract, subject to
statutory rights and remedies for misrepresentation. If a provision is invalid, remaining provisions continue where possible.
Failure to enforce a provision once is not a general waiver.
7.8 Assignment and third-party rights
We may transfer a contract where lawful and without materially reducing the customer’s rights. Customers may not transfer
assessment licences without written authorisation. No unrelated third party has contractual enforcement rights except where
the law or an express agreement provides otherwise.
7.9 Governing law and courts
These Terms are governed by the laws of England and Wales. Business disputes are subject to the courts of England and
Wales, subject to mandatory rules. Consumers retain any mandatory rights concerning applicable law and where they may
bring proceedings.
7.10 Contact
Questions about these Terms, orders, returns, assessment documentation or subscriptions should be sent to
info@fizzywhiz.com or via the website contact channels.
